class=\"P2\">&nbsp;<\/p><p class=\"P3\"><span>A 2\u00aa Turma do Tribunal Regional do Trabalho da 4\u00aa Regi\u00e3o (TRT-RS) reconheceu o v\u00ednculo empregat\u00edcio de um trabalhador que foi despedido de uma empresa de previd\u00eancia privada, mas continuou prestando servi\u00e7os de inform\u00e1tica para ela por meio de sua pr\u00f3pria microempresa. Para os desembargadores, as provas do processo demonstraram que o trabalhador permaneceu em uma rela\u00e7\u00e3o de emprego mesmo quando passou a atuar como pessoa jur\u00eddica: havia pagamento mensal, suas atividades estavam subordinadas a superiores hier\u00e1rquicos da empresa e ele comparecia quase diariamente \u00e0 sede para prestar servi\u00e7os de forma pessoal. A decis\u00e3o confirmou, no aspecto, a senten\u00e7a do juiz Edson Pecis Lerrer, da 22\u00aa Vara do Trabalho de Porto Alegre.<\/span><\/p><p class=\"P4\">&nbsp;<\/p><p class=\"P5\"><span>Conforme o processo, o autor foi contratado em agosto de 2008 para exercer a fun\u00e7\u00e3o de analista projetista e foi demitido sem justa causa em setembro de 2009. Ap\u00f3s a dispensa, ele continuou prestando servi\u00e7os para a empregadora, de setembro de 2009 a maio de 2015, por meio de uma empresa constitu\u00edda em seu nome. O trabalhador ajuizou a\u00e7\u00e3o para requerer, entre outros pedidos, o reconhecimento do v\u00ednculo de emprego nesse segundo per\u00edodo.<\/span><\/p><p class=\"P6\">&nbsp;<\/p><p class=\"P7\"><span>No primeiro grau, o juiz destacou que o depoimento do representante da empresa confirmou as alega\u00e7\u00f5es do autor do processo. No depoimento, ele admitiu que o trabalhador, ap\u00f3s ser despedido, permaneceu realizando as mesmas atividades e, inicialmente, se reportando ao mesmo superior hier\u00e1rquico. O magistrado concluiu que a pessoa jur\u00eddica foi constitu\u00edda para que o autor continuasse a prestar os servi\u00e7os para a empregadora, que estava \u201cmascarando o v\u00ednculo empregat\u00edcio\u201d. O juiz ressaltou que isso configura fraude trabalhista, por n\u00e3o terem sido concedidos os direitos sociais previstos constitucionalmente. Ao reconhecer o v\u00ednculo de emprego, a senten\u00e7a condenou a empresa ao pagamento de aviso pr\u00e9vio, f\u00e9rias vencidas e proporcionais, e 13\u00b0 sal\u00e1rios integrais, entre outras verbas trabalhistas.<\/span><\/p><p class=\"P8\">&nbsp;<\/p><p class=\"P9\"><span>A relatora do ac\u00f3rd\u00e3o no segundo grau, desembargadora Maria Silvana Rotta Tedesco, destacou que, para haver rela\u00e7\u00e3o de emprego, devem ser preenchidos os<\/span>&#x200b;&#x200b;&nbsp;<span>requisitos dos artigos 2\u00ba e 3\u00ba da CLT: haver um empregador e um trabalhador, que presta servi\u00e7os de forma pessoal, habitual, onerosa e com subordina\u00e7\u00e3o jur\u00eddica. Al\u00e9m disso, acrescentou que a comprova\u00e7\u00e3o de uma rela\u00e7\u00e3o de emprego depende \u201cn\u00e3o do que as partes tiverem pactuado, mas da situa\u00e7\u00e3o real em que o trabalhador se ache colocado\u201d. Desta forma, com base nas provas do processo, o ac\u00f3rd\u00e3o manteve o entendimento do primeiro grau e reconheceu o v\u00ednculo empregat\u00edcio no per\u00edodo em que o autor prestou servi\u00e7os via pessoa jur\u00eddica.<\/span><\/p><p class=\"P10\">&nbsp;<\/p><p class=\"P11\"><span>A decis\u00e3o foi un\u00e2nime na 2\u00b0 Turma. Tamb\u00e9m participaram do julgamento os desembargadores Mar\u00e7al Henri dos Santos Figueiredo e Alexandre Corr\u00eaa da Cruz.
