Contudo, quando n\u00e3o h\u00e1 essa possibilidade, ou seja, n\u00e3o s\u00e3o habilitados na Previd\u00eancia, ser\u00e1 necess\u00e1rio pedir \u00e0 Justi\u00e7a para que esta expe\u00e7a alvar\u00e1 judicial que autorize o saque do montante.<\/span><\/p><p class=\"P33\">&nbsp;<\/p><p class=\"P34\"><span>Para os n\u00e3o habilitados na Previd\u00eancia<\/span><\/p><p class=\"P35\">&nbsp;<\/p><p class=\"P36\"><span>Se, por acaso, voc\u00ea n\u00e3o estiver habilitado pela Previd\u00eancia Social como dependente ou herdeiro da pessoa falecida, ser\u00e1 necess\u00e1rio um alvar\u00e1 judicial autorizando a libera\u00e7\u00e3o dos valores.<\/span><\/p><p class=\"P37\">&nbsp;<\/p><p class=\"P38\"><span>Neste caso, ser\u00e1 necess\u00e1rio a contrata\u00e7\u00e3o de um advogado para que este possa dar entrada no pedido de alvar\u00e1 e ser\u00e1 preciso apresentar os seguintes documentos:<\/span><\/p><p class=\"P39\">&nbsp;<\/p><ul class=\"LFO2\" style=\"counter-reset: ulLFO2_1 0;\"><li style=\"color: initial; ou se, no regime<\/span>&#x200b;&#x200b;&nbsp;<span>da comunh\u00e3o parcial, o autor da heran\u00e7a n\u00e3o houver deixado bens particulares);<\/span><\/p><\/li><li style=\"color: initial; font-family: initial;hyphenate: false;hyphenate: false;font-family: Arial;mleft: 0.5in !important;margin-bottom: 0in !important;line-height: 1.5 !important;\"><p style=\"display: table-cell;margin-left:0 !important;text-indent: 0 !important;\" class=\"P46\"><span>aos ascendentes, em concorr\u00eancia com o c\u00f4njuge sobrevivente;<\/span><\/p><\/li><li style=\"color: initial;
