class=\"P3\"><span>Com base no princ\u00edpio do melhor interesse da crian\u00e7a e do adolescente, a 5\u00aa Turma C\u00edvel do Tribunal de Justi\u00e7a do Distrito Federal manteve a guarda compartilhada de duas crian\u00e7as cuja m\u00e3e se mudou para fora do Brasil. A resid\u00eancia dos menores deve ser alternada bienalmente entre os genitores.<\/span><\/p><p class=\"P4\">&nbsp;<\/p><p class=\"P5\"><span>Ap\u00f3s a separa\u00e7\u00e3o, a m\u00e3e se casou novamente e precisou morar fora do Brasil para acompanhar o atual companheiro, que exerce atividades diplom\u00e1ticas. Ela pediu a guarda unilateral dos filhos, que t\u00eam 9 e 11 anos, com o argumento de que eles sempre moraram com ela e a priva\u00e7\u00e3o do lar materno prejudicaria o desenvolvimento dos menores. J\u00e1 o pai alegou que a ida a outro pa\u00eds poderia causar depress\u00e3o nas crian\u00e7as.<\/span><\/p><p class=\"P6\">&nbsp;<\/p><p class=\"P7\"><span>A turma do TJ-DF lembrou que a Lei n\u00ba 13.058\/2014 define a guarda compartilhada como regra: \"Quando n\u00e3o houver acordo entre a m\u00e3e e o pai quanto \u00e0 guarda do filho, encontrando-se ambos os genitores aptos a exercer o poder familiar, ser\u00e1 aplicada a guarda compartilhada, salvo se um dos genitores declarar ao magistrado que n\u00e3o deseja a guarda do menor\".<\/span><\/p><p class=\"P8\">&nbsp;<\/p><p class=\"P9\"><span>Segundo os magistrados, \u00e9 normal que crian\u00e7as tenham maior apego ao lugar em que sempre residiram, e por isso seria normal que a ideia de mudan\u00e7a para outro pa\u00eds gerasse ang\u00fastia. Tamb\u00e9m foi apontado que a mudan\u00e7a de pa\u00eds representaria rica experi\u00eancia cultural e social para os menores.<\/span><\/p><p class=\"P10\">&nbsp;<\/p><p class=\"P11\"><span>\"Embora importante o contato das crian\u00e7as com amigos e familiares residentes no Brasil, assim como com o pai, igualmente importante a conviv\u00eancia com a m\u00e3e, indispens\u00e1vel para o desenvolvimento psicol\u00f3gico e emocional dos filhos e para a preserva\u00e7\u00e3o e fortalecimento do v\u00ednculo afetivo materno\", destaca a decis\u00e3o.<\/span><\/p><p class=\"P12\">&nbsp;<\/p><p class=\"P13\"><span>O colegiado concluiu que a altern\u00e2ncia de resid\u00eancia a cada dois anos garantiria equidade na conviv\u00eancia das crian\u00e7as com os pais e possibilitaria o<\/span>&#x200b;&#x200b;&nbsp;<span>fortalecimento do v\u00ednculo e a manuten\u00e7\u00e3o de ambos como refer\u00eancias de afeto.
